Terms & Conditions

These Terms and Conditions ("Terms") govern your use of TreatRight Kenya ("TreatRight", "we", "us"), operated in the Republic of Kenya. By creating an account, sending a Gift, or otherwise using the platform, you agree to these Terms. If you do not agree, please do not use the service.

1. Definitions

  • Sender — a person who purchases a Gift for someone else.
  • Recipient — the person a Gift is sent to, identified by phone number.
  • Vendor — an independent restaurant, café, or bar that fulfils Gifts.
  • Gift — a prepaid meal or drink, tied to a specific Vendor and menu item (or an equivalent value the Recipient may swap it for), purchased through the platform.

2. Eligibility

You must be at least 18 years old and able to form a binding contract under Kenyan law to create a Sender account or make a purchase. A valid Kenyan phone number is required to create a Sender account and to receive Gifts as a Recipient.

3. What TreatRight is (and isn't)

TreatRight is a facilitation platform that connects Senders, Recipients, and Vendors. We are not the Vendor: we do not prepare, sell, or serve the food or drink itself, and each Vendor is an independent business responsible for the quality, safety, and lawful preparation of what it serves, including compliance with applicable Kenyan public health and food-safety regulations.

4. Payment

Gifts are paid for in full via Paystack (which supports M-Pesa, card, and bank transfer) at the time of purchase. Payment is collected into TreatRight's own account; TreatRight's flat platform fee is added on top of the listed price and shown to the Sender before they pay, not deducted from what the Vendor receives — the Vendor is settled separately, after the Gift is marked paid, for the full original price of what was gifted. If the Sender adds delivery (only available where a Vendor offers it), the Vendor's flat delivery fee is shown and paid at the same time, and is likewise passed on to the Vendor in full. Senders are never charged more than the listed price of the Gift plus the platform fee and any delivery fee disclosed at checkout.

5. Redemption and expiry

Each Gift includes a secure, single-use redemption link and a short code the Recipient can show at the Vendor's counter. Redemption links are valid for 72 hours from the moment payment is confirmed. Once a Gift is redeemed, it cannot be redeemed again or modified further.

Within the original Gift's value, a Recipient may swap the specific item for another item on the same Vendor's menu, subject to availability. TreatRight does not disclose to the Recipient what the Sender paid, only the value available to spend.

If a Gift is not redeemed before it expires, please contact us — expired Gifts are reviewed on a case-by-case basis and are not automatically refunded.

Where delivery was added at checkout, the Recipient provides the delivery address at the time of redemption — the Sender only chooses and pays for delivery in advance, since the Recipient is the one who knows where the Gift should actually go.

6. Prohibited use

You agree not to:

  • use the platform for any fraudulent, unlawful, or abusive purpose;
  • attempt to guess, share, resell, or circumvent redemption tokens or codes belonging to someone else;
  • interfere with or attempt to gain unauthorised access to any part of the platform; or
  • use the platform to send Gifts to a phone number without the honest belief that its owner would welcome it.

We may suspend or terminate any account used in violation of these Terms.

7. Account responsibility

Senders are responsible for keeping their phone number confidential and for anything done through an account signed in with it. Vendor staff and admin accounts are responsible for their login credentials. TreatRight is not liable for losses arising from a failure to keep these secure.

8. Liability

To the fullest extent permitted under Kenyan law, TreatRight provides the platform on an "as is" and "as available" basis and is not liable for indirect or consequential loss, for the acts or omissions of any Vendor, or for disruptions caused by third-party services we rely on (including our payment processor, Paystack). Nothing in these Terms limits any right or protection you have under the Consumer Protection Act, 2012 or other applicable Kenyan law that cannot be lawfully excluded.

9. Changes to these Terms

We may update these Terms from time to time. Continued use of the platform after an update constitutes acceptance of the revised Terms. Material changes will be reflected by updating the "Last updated" date above.

10. Governing law and disputes

These Terms are governed by the laws of the Republic of Kenya. Any dispute arising from these Terms or your use of TreatRight will first be addressed informally by contacting us; if unresolved, the courts of Kenya shall have exclusive jurisdiction.
